ROME — One man has been charged after damaging his brother’s car with rocks on Elm Street in Rome Wednesday afternoon, according to the Rome Police Department.

The initial calls to 911 reported possible shots fired, but police said that was just the sound of a rock going through a car window.

Police said David L. Simmons, 44, of Rome, was in a dispute with his brother on Elm Street at about 1:24 p.m. Wednesday. Police said Simmons threw two rocks at his brother’s car, one of which dented the side and the other shattered the rear window.

Neighbors in the area called 911 to report a possible gunshot and police said Simmons fled the scene. He was taken into custody a short time later.

Simmons is charged with two counts of fourth-degree mischief, a misdemeanor, police said. He is scheduled to appear in Rome City Court.
